Terms of use for the stressindex.io website, the Stress Index app and the professional area, provided by The Performance Lab S.r.l..

1. The service
Stress Index is a software service provided by The Performance Lab S.r.l. (the "Provider") and made up of: • the Stress Index mobile app, with which the professional or their client records heart rate variability (HRV) measurements with a compatible chest strap; • the stressindex.io website and its reserved area ("Professional Area"), where the professional reviews measurements, trends over time, reports and the tools of the active modules; • related services (email notifications, PDF reports, exports). The service is intended for wellness and sports professionals (physiotherapists, osteopaths, trainers, coaches) who use it as part of their professional activity. It is not intended for consumers. These Terms govern access to and use of the service. By creating an account or using the service you confirm that you have read and accepted them, together with the Privacy Notice and the Cookie Policy.
2. Account and requirements
Using the Professional Area requires a personal account, created on the registration page with first name, last name, email and profession. You warrant that the details you provide are accurate and keep them up to date. The account is personal and cannot be transferred. Keep your credentials safe: you are responsible for every activity carried out with your account and must notify the Provider immediately at support@stressindex.io of any unauthorized use. End clients access the app through an invitation from the professional. The professional remains the sole point of contact in the relationship with their clients. The service requires an up-to-date device and browser, an Internet connection and, for measurements, a compatible chest strap as listed in the Guides. Connection and hardware costs are borne by the user.
3. Free trial and subscription
[DA COMPLETARE CON IL LEGALE] Every new professional account starts with a 60-day free trial, during which the full service is available. At the end of the trial the service continues under the chosen subscription, at the price and billing period shown on the website at the time of subscription; prices are in euros, VAT excluded unless stated otherwise. The subscription renews automatically at the end of each period unless cancelled. You can cancel at any time; cancellation takes effect at the end of the current period, and no refunds are given for periods already started. The Provider may change the price list with at least 30 days' written notice; changes apply from the next renewal. Additional modules (for example Sport or Monitoring) may have their own pricing, shown at activation. If payment fails, the Provider may suspend access to the Professional Area until the balance is settled, keeping the data for the period indicated in the section "Suspension and termination".
4. Obligations of the user and of end clients
[DA COMPLETARE CON IL LEGALE] You agree to: • use the service in compliance with the law, these Terms and the rules of your profession; • obtain, before inviting a client, their informed consent to the processing of their data, as required by the Privacy Notice (the professional is the data controller for their clients' data); • not upload content that is unlawful, offensive or infringes third-party rights; • not attempt to circumvent security measures, access other people's accounts or data, decompile or copy the software, or use the service to build a competing product; • not use automated systems (scraping, bots) to extract data from the website or the app, other than the export functions provided; • not resell or sublicense the service. You are responsible for the content you enter (notes, client data, settings) and for the use you make of the information provided by the service.
5. Nature of the service: wellness, not medicine
Stress Index is a support tool for wellness and sports professionals. It measures and displays heart rate variability indicators and turns them into scores and trends that help read a person's adaptation, recovery and load. Stress Index is not a medical device, does not provide a diagnosis, does not prescribe treatment and does not replace the advice of a physician. Scores, thresholds and alerts are statistical wellness indications and do not constitute a medical assessment. Any decision about health must be taken with a physician; in case of symptoms or discomfort, contact the health services. The professional uses the service under their own responsibility and within the limits of their competence, and agrees not to present it to clients as a diagnostic or treatment tool.
6. Intellectual property
[DA COMPLETARE CON IL LEGALE] The software, calculation algorithms, interfaces, texts, graphics, the "Stress Index" trademarks and the domain name are owned by the Provider or its licensors and are protected by copyright and industrial property law. With the subscription you receive a personal, non-exclusive, non-transferable and revocable licence to use the service for your professional activity for the duration of the subscription. No other right is granted. The data you enter and your clients' measurements remain yours and your clients'. You grant the Provider the right to process them to the extent needed to deliver the service, as described in the Privacy Notice. The Provider may use aggregated, anonymous data that cannot be traced back to individuals to improve the service.
7. Limitation of liability
[DA COMPLETARE CON IL LEGALE] The Provider undertakes to keep the service available and up to date with professional diligence, but does not guarantee that it will be error-free or accessible without interruption. Maintenance work is announced in advance whenever possible. To the extent permitted by law, the Provider is not liable for indirect damages, loss of profit, loss of data due to causes not attributable to the Provider, or decisions taken by the user or their clients on the basis of information provided by the service. In any case, the Provider's total liability towards the user does not exceed the amount paid by the user for the service in the 12 months preceding the event. The service depends on third-party providers (hosting, authentication, email delivery, app stores) and third-party hardware (chest straps, smartphones): the Provider is not liable for malfunctions attributable to these parties. Nothing in these Terms limits liability for wilful misconduct or gross negligence, or any other liability that cannot be excluded by law.
8. Suspension and termination
[DA COMPLETARE CON IL LEGALE] You may terminate at any time by cancelling the subscription or requesting deletion of the account at support@stressindex.io. Termination takes effect at the end of the current subscription period. The Provider may suspend or close the account, notifying the user, in case of serious or repeated breach of these Terms, non-payment, use that endangers the security of the service, or a request from the authorities. After the account is closed, data remain exportable for 30 days; after that period they are deleted or anonymized as described in the Privacy Notice, subject to legal retention obligations. It is the professional's responsibility to export their clients' data before closure and to inform them. The Provider may discontinue the service or individual features with at least 90 days' notice, refunding the unused part of the subscription.
9. Governing law and jurisdiction

Any dispute concerning their interpretation or performance is subject to the exclusive jurisdiction of the court of the Provider's registered office, without prejudice to the mandatory jurisdiction provided by law for users acting as consumers. The Provider may update these Terms. Material changes are communicated by email or in the reserved area at least 30 days in advance; using the service after the effective date counts as acceptance. If you do not wish to accept them, you may terminate free of charge before that date. If any clause is found to be invalid, the remaining clauses remain in force.
